Last Updated: April 2026
At Pancho Patagon SpA, we are committed to protecting your privacy and ensuring the security of your personal data. This Privacy Policy explains how we collect, use, and safeguard your information in accordance with the laws of the Republic of Chile, the EU General Data Protection Regulation (GDPR), and applicable US state privacy laws.
1. Information We Collect
To provide our expedition and rental services, we collect the following categories of information:
- Identification Data: Full name, passport number, and country of residence.
- Contact Information: Email address, physical address, and telephone number.
- Payment and Financial Data: Billing details and transaction history. Please note that we do not store full credit card numbers; these are processed by secure, PCI-compliant third-party providers.
- Rental Documentation: Driver’s license details, fuel receipts (for maintenance validation), and photographic records of the vehicle condition.
2. Legal Basis for Processing
We process your data based on:
- Contractual Necessity: To manage your booking and execute the Rental Agreement.
- Legal Obligation: To comply with Chilean tourism regulations (SERNATUR), tax laws (SII), and cross-border customs requirements.
- Legitimate Interest: To ensure the safety of our fleet via GPS tracking (if applicable) and to maintain the technical integrity of our units.
3. Data Retention and Security
- Retention: We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including the 60-day security deposit hold period to monitor for delayed traffic fines or tolls.
- Security: We implement technical and organizational measures to protect your data against unauthorized access, loss, or alteration.
4. International Data Transfers and Third Parties
Your data may be shared with:
- Insurance Providers: To facilitate coverage and claims in Chile and Argentina.
- Authorities: Police or municipal authorities in the event of traffic violations or accidents.
- Cross-Border Logistics: Customs and immigration agencies for necessary travel permits.
5. Your Rights (GDPR & US Privacy Laws)
Depending on your residency, you may have the following rights:
- Access and Rectification: The right to request a copy of your data and correct inaccuracies.
- Erasure (“Right to be Forgotten”): The right to request deletion of your data, subject to legal retention requirements (e.g., tax or insurance audits).
- Data Portability: The right to receive your data in a structured, machine-readable format.
- Withdraw Consent: Where processing is based on consent (e.g., marketing), you may withdraw it at any time.
6. Cookies and Tracking
We do not use advertising, analytics, or tracking cookies, and we do not build profiles of our visitors. The only cookies that may be set are strictly necessary ones, for example, the security check (Cloudflare Turnstile) on our contact form, which helps prevent spam and abuse. Because these are essential to a service you actively request, they are exempt from consent requirements, and no cookie banner is shown.
Our pages also load typography from Google Fonts. This sets no cookies, but your browser does contact Google’s servers, which exposes your IP address, when fetching the fonts. You can block or delete cookies at any time through your browser settings. Should we ever introduce analytics or marketing cookies in the future, we will add a consent banner and update this policy beforehand.
